Defence of Enforcement

It is an unfortunate reality that some premises face enforcement, with potentially devastating consequences such as reduced operating hours, removing or restricting licensable activities, unworkable conditions, suspending or even revoking licences. Enforcement can arise from various sources such as the Police, Environmental Health Department or residents.

The Police may issue an application for a summary review following a serious incident, or a standard review as a result of perceived increases of crime and disorder. The Environmental Health Department might seek to remove live music from a licence due to noise complaints, local residents might take issue with changes in operating styles such as increased use of a refurbished beer gardens or, the Licensing Authority or Trading Standards Department may take action on the back of failed test purchases.

In some cases, enforcement actions instigated by the person or body are justified and necessary changes must be made at the premises to benefit all parties. However, there are instances where authorities or residents are mistaken. In both scenarios, our licensing team are well-positioned to help.
