Land & Property Dispute Resolution

Colin Fenny joined Harrison Drury in 2010 from Brabners and has built a specialist team of property litigators. He has worked both in private practice and in-house. Qualifying into the Royal Mail in-house legal department in 2000, he spent four years in its litigation team dealing with both commercial and property related disputes including £multi-million contract and commercial claims and providing litigation support in the management of its real estate portfolio.

Colin moved to Brabners in 2004 and continued to deal with a variety of commercial and property disputes. A notable case highlight at Brabners was the resolution of a £multi-million PFI contract termination claim against the MOD for Parkwood Holdings Plc.

Joining Harrison Drury in 2010 he has specialised exclusively in property and construction disputes. He has been a partner since 2014 and head of the Property Litigation team since 2017.

As a result of his career background, Colin provides a balanced perspective which takes account of the different positions of parties involved in disputes and the key business objectives involved, enabling him to effectively identify routes to deal with disputes and achieve commercially focused outcomes for clients.  Colin uses a collaborative and pro-active approach to both prevent and resolve disputes for his retained clients.

Colin’s practice predominantly focuses on commercial landlord and tenant disputes including dealing with opposed and unopposed lease renewals, rent reviews, break notices and enforcement of tenant/landlord covenants as well as issues relating to Minimum Energy Efficient Standard (MEES) and telecoms. Colin also has experience of a wide spectrum of real estate disputes including enforcement of restrictive covenants and easements over land and removal of travellers.

Colin does however have a particular niche in dealing with disputes relating to professional negligence by property professionals such as surveyors, solicitors, valuers and agents, utilising his deep working knowledge of property law to assist clients prosecuting such professionals.

Reported cases at Harrison Drury include: Parkwood Leisure Ltd v Laing O’Rourke Wales and West Ltd; Grange v Quinn; Windermere Marina Village Ltd v
