Land & Property Dispute Resolution

Joseph joined Harrison Drury in December 2021 from a midlands firm where he specialised in Rural and Agricultural disputes and property disputes. He acts for both landlords and tenants in agricultural tenancy disputes including succession claims, forfeiture, surrenders and termination. He has recently been advising on partnership matters with large amounts of land at stake, issues regarding renewables and legal rights such including grazing and shooting and tenancies where the land is used for equestrian purposes. He has experience in drafting all notices under the Agricultural Holdings Act 1986 and the Farm Business Tenancies Act 1995 and litigates all matters involving notices, including seeking possession and arguing about the validity of notices, in the courts, tribunals, and arbitration.

He has a wide ranging real estate litigation practice dealing with boundary disputes, adverse possession, claims relating to interference with easements and the enforcement of restrictive covenants as well as acting for commercial landlords and tenants in 1954 Act claims and homeowners in residential property disputes, together with disputes around the sale of property and misrepresentation claims arising out of sales. He has experience of all types of dispute resolution including litigation, arbitration, tribunal proceedings and ADR.

His recent highlights including settling on an ongoing nuisance and professional negligence dispute in his client’s favour, resolving a long-standing dispute regarding a property trust and a large six figure unjust enrichment claim. He has also resolved claims under the Trusts of Land and Appointment of Trustees Act and successfully argued that a Compulsory Purchase Order should be revoked.

Joseph is a member of the Agricultural Law Association and the Country Landowner Association.
